Terms of Use

1. Parties and Definitions

1.2. User: the natural person who downloads the App, creates an account, or benefits from the Service.

1.3. Content: all text, images, analysis results, recommendations, routines, magazine content, artificial-intelligence output, and other materials made available within the App.

2. Nature of the Service

2.1. BEAUTY MIND is a personal-care and lifestyle application that provides image-based skin analysis, personalized skincare routines, product and content recommendations, environmental insights, and AI-assisted guidance.

2.2. Skin analysis is performed through third-party technology providers, and AI-based content generation relies on external service providers.

2.3. Medical Disclaimer (Important): BEAUTY MIND is not a health, medical, or diagnostic service. The skin analyses, scores, recommendations, and content provided by the App are for general informational and personal-care purposes only. They do not constitute medical advice, diagnosis, or treatment, and are not a substitute for examination, diagnosis, or treatment by a physician, dermatologist, or other qualified health professional. If you have a medical concern about your skin, always consult a qualified health professional. Never rely on information from the App as a substitute for professional medical advice.

2.4. Skin age, skin score, and similar measurements produced by the App are estimative and statistical in nature and must not be interpreted as precise or clinical results.

3. Accounts and User Obligations

3.1. You may need to create an account to use the full Service. You agree to provide accurate, current, and complete information.

3.2. You are responsible for maintaining the confidentiality of your credentials and for all activity carried out through your account.

3.3. If you are under 18, you may use the App only under the supervision and with the consent of a parent or legal guardian. The Company reserves the right to request age verification where necessary.

As a user, you agree not to:

• Use the App unlawfully, deceptively, or in a way that infringes the rights of third parties.
• Reverse-engineer, copy, modify, or create derivative works of the App's source code.
• Attempt to bypass security measures or gain unauthorized access to any systems.
• Upload another person's image, identity, or personal data without authorization.
• Access the Service through automated systems (bots, scrapers) or place it under abnormal load.

4. Subscriptions, Fees, and Automatic Renewal

4.1. The App offers paid subscription plans ("Premium Membership") for access to certain premium features. Features available for free and those included in Premium Membership are indicated within the App.

4.2. All purchases and subscriptions are processed through the Apple App Store and Apple's payment infrastructure. Payment is charged to your Apple account upon confirmation of purchase.

4.3. Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period, and the renewal fee is charged within that period. You can manage or cancel your subscription in your Apple ID settings.

4.4. Where a free trial is offered, any unused portion is forfeited if you purchase a subscription to the same service.

4.5. Refunds are subject to the Apple App Store's refund policies. The Company cannot issue refunds directly for purchases made through Apple; refund requests must be directed to Apple.

4.6. The Company reserves the right to change subscription fees prospectively. Price changes are notified appropriately before taking effect and do not affect your current subscription period.

5. Intellectual Property

5.1. All intellectual property rights in the App and Content (including trademarks, logos, design, software, text, images, and algorithms) belong exclusively to the Company or its licensors. The "BEAUTY MIND" name and logo are owned by the Company.

5.2. You are granted a limited, non-exclusive, non-transferable, revocable licence to use the App for personal, non-commercial purposes. This licence does not transfer any ownership in the Content.

5.3. You retain your rights in the images and data you upload. To the extent necessary to provide the Service, you permit us to process such content. Details of processing are set out in the Privacy Policy.

6. Third-Party Services

The App relies on third-party providers for functions such as skin analysis, authentication, cloud infrastructure, AI content generation, and subscription management. Use of these services may also be subject to the relevant provider's own terms. The Company exercises reasonable care to ensure that providers with whom data is shared maintain an appropriate level of protection.

7. Limitation of Liability

7.1. The Service is provided "as is" and "as available". The Company makes no express or implied warranty that the Service will be uninterrupted, error-free, or fit for a particular purpose.

7.2. To the fullest extent permitted by applicable law, the Company shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of or inability to use the App, or from decisions made in reliance on skin analysis results or recommendations.

7.3. Nothing in this section affects your statutory rights under consumer legislation that cannot be limited by contract.

8. Termination and Account Deletion

8.1. You may delete your account at any time from the relevant section within the App. Upon deletion, your personal data is deleted or anonymized in accordance with the Privacy Policy and our retention periods.

8.2. The Company may suspend or terminate your account if you breach these Terms or where required by law.

8.3. Provisions that by their nature should survive termination (including intellectual property, limitation of liability, and governing law) remain in effect.

9. Changes

The Company may update these Terms from time to time. Material changes will be notified within the App or through other appropriate channels before taking effect. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

10. Governing Law and Dispute Resolution

10.1. These Terms are governed by and construed in accordance with the laws of the Republic of Türkiye.

10.2. The Istanbul (Çağlayan) Courts and Enforcement Offices shall have jurisdiction over disputes arising from these Terms. For users qualifying as consumers, the competence of the relevant consumer arbitration committees and consumer courts is reserved.
